Don’t execute killer, slain El Cerrito couple’s son says

0 Comments | Oakland Tribune, Oct 30, 2009 | by Malaika Fraley

MARTINEZ — The 20-year-old son of a slain El Cerrito couple is fighting to speak against imposing the death penalty on the uncle who killed his parents, testing for the first time a state law that gave crime victims a greater voice in legal proceedings.

Eric Rogers is scheduled to testify for the prosecution next week during the penalty phase of the murder trial of Edward Wycoff, a 40- year-old Sacramento County truck driver convicted Monday of two counts of first-degree murder for killing his sister and brother-in- law, Paul and Julie Rogers, on Jan. 31, 2006.

While legal precedent limits Eric Rogers to testifying only to the impact the murders have had on his life, Rogers said he wants to sacramento homes tell jurors that he doesn’t want Wycoff executed. His parents were strongly opposed to the death penalty, as is he, he said.

“I think revenge would bring me closer to the status of my uncle and further from the status of my parents,” Eric Rogers told the Times. “To be vengeful in their name would be disrespectful.”

Rogers hired Berkeley attorney Ted Cassman to argue that he has a right to voice his opposition to capital punishment under Marsy’s Law, also known as Proposition 9 or the Victim’s Rights and Protection Act of 2008, which voters approved last November. Marsy’s Law gives victims the right to be heard at any legal proceeding.

Beyond Rogers’ belief that the death penalty is wrong, such a sentence would cause Rogers more pain by subjecting him to 10 to 20 years of appeals on Wycoff’s behalf, Cassman said.

Wycoff prosecutor, Mark Peterson, argues that case law states that jurors need to decide whether a defendant deserves death, not how a death sentence would impact others. Wycoff, acting as his own attorney, argued that the Rogers couple deserved to be killed because they treated him badly. He told the court that he’s not taking a position on his nephew’s challenge because Cassman never returned his phone calls and is, therefore, a “dirt bag.”

British Airways Pleads Guilty in Air Cargo Price-fixing Conspiracy

Market Wire, October, 2009

The Competition Bureau announced today that British Airways Plc has pleaded guilty in the Federal Court and has been fined $4.5 million for participating in an air cargo cartel affecting Canada.

British Airways admitted to fixing surcharges on the sale and supply of international air cargo exported on certain routes from Canada between April 2002 and February 2006.

“The fines obtained as a result of our investigation into the air cargo price-fixing conspiracy reflect the serious nature of this behaviour,” said Melanie Aitken, Commissioner of Competition. “The Bureau is committed to uncovering such anti-competitive agreements that harm Canadians, and taking criminal landscape photography action against the conspirators.”

The Bureau’s investigation has benefited from the cooperation of British Airways and certain other air cargo carriers through the Bureau’s Leniency Program. This program creates incentives for parties to address their criminal liability by co-operating with the Bureau in its ongoing investigation and prosecution of other alleged cartel participants.

British Airways’ penalty brings the total fines in the Bureau’s air cargo inquiry to more than $14.6 million. Previously, Air France, KLM, Martinair and Qantas each pleaded guilty to fixing air cargo surcharges for shipments on certain routes from Canada. The Bureau’s investigation into the alleged conduct of other air cargo carriers continues.

Under the Competition Act, any agreement between competitors to fix prices that results in an undue lessening of competition in Canada is a criminal offence

Linear morphea with secondary mucinosis

Linear morphea with secondary mucinosis

Indian Journal of Dermatology, Venereology and Leprology, Jul/Aug 2009 by Khandpur, Sujay, Singh, Saurabh, Sharma, Vinod, Gupta, Ruchika, Singh, Manoj

Introduction

Mucin deposition is a common histological feature of various connective tissue diseases such as lupus erythematosus and dermatomyositis. In scleroderma, small and interstitial deposits of mucin are occasionally seen in the deep dermis and interlobular septa of subcutis. [1] There are only isolated reports of scleroderma associated with abundant mucin deposits, manifesting as papules within or occurring beyond the indurated plaque. We describe an unusual case of linear morphea evolving into generalized morphea with excessive mucin deposition, without any systemic involvement.

Case Report

A 7-year-old boy developed a linear, slowly progressive, bound-down plaque on the right thigh at 18 months of age preceded by MMR (Measles Mumps Rubella) vaccine. Subsequently, he developed similar plaques on the other thigh, lower abdomen and back. He had no systemic complaints. Dermatological examination revealed linear, light brown, well- to ill-defined, bound- down indurated plaques with overlying mild hypertrichosis in isolated plaques only, on lateral aspect of both thighs, lower abdomen and back [Figure manifesting abundance 1] and [Figure 2]. A diagnosis of linear morphea evolving into generalized morphea was made. Skin biopsy done from outside was reported as cutaneous mucinosis. A repeat skin biopsy performed at our institute showed epidermal atrophy, hyalinization of collagen throughout the dermis and mucin deposition in upper reticular dermis [Figure 3]a. On alcian blue- Periodic Acid Schiff stain, abundant mucin deposition was demonstrated in the upper reticular dermis [Figure 3]b. Investigations including hematological, biochemical, serum and urine protein electrophoresis, thyroid function tests and antinuclear antibody (ANA) were normal.

A diagnosis of morphea with secondary mucinosis was made and oral mini-pulse steroid therapy with betamethasone, 3mg every Saturday and Sunday initiated. Six months of treatment showed no response and repeat skin biopsies from right thigh and abdominal plaque showed features compatible with scleroderma. The dose of betamethasone was increased to 4 mg but with no improvement.

Discussion

This is an unusual case of linear morphea with abundant mucin deposition. Mucin deposition is a constant feature in both morphea and systemic sclerosis as shown in some case series

The omega-3 burn

Muscle & Fitness, Nov, 2009

A recent study shows more compelling evidence that omega-3 fatty acids are important for keeping bodyfat away. Researchers from the University of Newcastle (Australia) placed 124 men and women of varying weights into three categories based on their body mass indexes (BMIs): healthy weight, overweight and obese. Blood samples were taken after subjects fasted for 10 hours and were measured for omega-3 concentration.

The scientists reported in a new issue of the British Journal of Nutrition that the overweight and obese subjects had significantly lower levels of omega-3 fatty acids in their blood than those in the healthy-weight category. They also found that the lower the subjects’ omega-3 levels were, the higher their BMIs, waist sizes and hip circumferences were.

Practical Application: To obesity surgery prevent fat accumulation, make fatty fish such as salmon and trout a regular part of your diet, and take 1-3 grams of fish oil with 2-3 meals per day.
